USER AGREEMENT

TrackData Systems Corporation operates the trackinfo.com Web site (“Site”) for informational purposes only. TrackData Systems Corporation makes no representations or warranties regarding the accuracy, completeness, suitability or availability of the entries, results, charts or program pages (“Content”) appearing on the Site. Content is provided “as is” and TrackData Systems specifically disclaims the implied warranties of merchantability and fitness for any particular purpose. TrackData Systems shall not be liable for any direct, indirect, special or consequential damages arising out of or in connection with your use of the Content.

CONTENT IS INTENDED FOR YOUR PERSONAL USE ONLY

Any other use of the Content will be viewed as a commercial use in violation of the “Personal Use” restriction accepted by you in return for access to the Content. You are prohibited from disseminating the Content – in whole or in part – or any information/data comprising the Content in a printed or electronic format. Content may not be made available on any Internet server, bulletin board service, facsimile-on-demand service or disseminated by any other electronic means including, but not limited to electronic mail systems without the prior written consent of TrackData Systems Corporation. The placement of Internet terminals in simulcast facilities to provide Content in a printed format shall be deemed a commercail use in violation of this Agreement.

These restrictions will be strictly enforced to the full extent of all applicable laws. Violation of the “Personal Use” restriction may expose you to an action for injunctive relief or monetary damages, and any other relief permitted under state and federal law, including court costs and attorneys' fees.

TrackData Systems reserves the right to modify the Site or the format of the Content at any time without prior notice and without liability for any direct, indirect, special or consequential damages arising out of or in connection with the modifications.

Your use of the Site or its Content constitutes acceptance of this Agreement.
